Cot Couture fully respects your privacy and will keep all of your personal details secure and confidential. Any information you submit is only used in order to process your order. Your personal details will not be sold, exchanged, or disclosed unless required by law.
The Owner and Operator of this Site is Jessica Blown trading as Cot Couture PO Box 153 One Tree Hill, SA, 5114, Australia (referred to as "Cot Couture", "we" and "us"). Access to this Site is given to you by us on these written conditions as amended from time to time ("Terms and Conditions"). By proceeding beyond this page you acknowledge that you have read and understood these Terms and Conditions. By purchasing an item from this Site and/or completing the registration process to become a member of Cot Couture ("a Member"), you expressly agree to be bound by these Terms and Conditions.
TERMS AND CONDITIONS We reserve the right to amend these Terms and Conditions from time to time with immediate effect. Your continued use of this Site after any amendment whether or not you receive express notice of the amendment constitutes an agreement by you to abide to be bound by these Terms and Conditions, as so amended.
GENERAL The goods and services displayed on this Site are available for purchase only by those persons over 18 and who have full capacity to enter binding contracts. All goods and services displayed on this site are for delivery in Australia and noted overseas contries only. We are obliged to deliver only to the address in which you have specified and we will not be liable for any loss or damage which occurs because you are unable to take delivery at the place specified.
ABOUT YOUR INFORMATION AND DETAILS If you are entering information on behalf of any other person (including a company or a trust) you must identify that other person. All information provided by you when placing an order or accessing any part of this site is referred to in these Terms and Conditions as “Your Information”. When you provide Your Information you are representing and warranting that it is true and correct and are agreeing to indemnify us for any losses, costs and expenses or damages that we may suffer if any of this information is not correct. When you decide to purchase any goods from this site, your payment is arranged directly with our bankers, Commonwealth Bank, through a secure link to that bank. We do not hold, nor do we have any access to your credit card details. You should review our Privacy Statement for further information concerning the collection and usage of Your Information. You grant us the right to disclose aspects of Your Information provided we observe our Privacy Statement. You must not transmit or attempt to transmit any material of any kind to this Site which contains a virus, malicious computer code which is or is likely to be destructive of data or programming or other harmful component. You must not otherwise attempt to alter any of the content on this Site. If any of Your Information is incomplete or inaccurate we reserve the right to decline any offer to purchase goods or services and terminate your access to the Site. In addition to our rights to terminate any access or transaction and to seek redress for any damage, you may be subject to penalties under Australian Criminal Law.
You acknowledge and consent to the disclosure by us to any law enforcement agency or government authority authorised to compel production of such information under Australian law that is investigating any breach or suspected breach of any law in any jurisdiction of your identity or other information provided by you to this Site, upon being requested to do so by that law enforcement agency.
ORDERS If you make an order it is deemed and constitutes an offer by you to purchase the quantity of goods or services (as the case may be) for the price (including the delivery and other charges) specified on this Site at the time you place your order. We reserve the right to accept or reject your offer for any reason, including, without limitation, the unavailability of any product, an error in the price or the product description posted on this Site, or an error in your order. Prices of products and services and delivery and other charges displayed on this Site are current at the time of issue, but may change at any time and are subject to availability. The availability of products and services may change from time to time. We retain title to the products you order until you have made payment in full for those products, but all risk in the products will pass to you on dispatch from our office. All prices do not have GST (Cot Couture is not registered for GST) but you are responsible for any taxes, duties or other liabilities imposed by any governmental agency, including without limitation, any customs duty, or any tax imposed by any government or government authority on any products or services acquired or ordered by you from this Site.
DELIVERY We may need to order products which are not immediately in stock from our suppliers. This may result in an extended delivery time or the products may be unavailable. If this occurs, we will notify you immediately to arrange a refund or exchange at your option. In particular, certain products may be hand-made or crafted and all orders for those products are placed on the basis of a minimum delivery time of four weeks.
RETURNS You agree to be bound by the terms of returns policy set out in this paragraph. The liability of Cot Couture with respect to returns is limited as expressed in this paragraph and generally in these Terms and Conditions. Goods will be accepted for return only if they are received at Cot Coutures office within twenty-one days of despatch, with an email within 7 days, with all in-store packaging and labelling intact and otherwise in saleable condition. Credit will be given against future purchases, a gift voucher to the value of the purchase or a money back refund will be issued at your option. You must pay the cost of all return freight and insurance before the return will be accepted.
TERMINATION
Should you object to any of these Terms and Conditions (including any subsequent amendments), you must immediately: · discontinue use of this Site ; and · notify us by electronic mail, facsimile or post and terminate your Membership. Termination in these circumstances will take effect after our obligations to supply and deliver the goods and your obligations to pay for and accept the goods has been completed in accord with the remainder of these terms and conditions.
CREDIT CARD AND PASSWORD SECURITY Even though most banks limit your liability in certain circumstances, you may be held liable by us for fraudulent use of your credit or debit card if your actions have contributed to the unauthorised use of your credit card. In the event of unauthorised use of your credit card, you must notify your credit card provider in accordance with its reporting rules and procedures.
COPYRIGHT Unless otherwise indicated, copyright in all works and subject matter other than works (including layout) on this Site is owned by Cot Couture. This Site or any portion of this Site may not be reproduced, duplicated, copied, sold, re-sold or otherwise exploited for any commercial purpose that is not expressly permitted. You may download a single copy of the information on this Site for your use or for use by a member of your immediate family and, where necessary for its use as a reference, keep an ephemeral copy for the purpose of reading and making a single hard copy of that information. Except as permitted under the Copyright Act 1968 (Cth) or other applicable laws, no part of the information contained on this Site may be otherwise reproduced, adapted, performed in public or transmitted in any form by any process (graphic, electronic or mechanical, including further copying, recording, taping or by a storage and information retrieval system) without our specific prior written approval.
YOU MUST CHECK FOR VIRUSES AND BUGS Information (including any file) obtained from or through this Site is not represented nor can it be relied upon to be free from computer viruses or other faults or defects. It is your responsibility to scan any such information for computer viruses. You expressly agree that we will not be liable to you or to any other person for any loss or damage (whether direct, indirect, consequential or economic), however caused and whether by negligence or otherwise, which may result directly or indirectly from any such information. To the extent that any applicable law that cannot be excluded imposes any liability on Cot Couture, that liability shall be limited to the cost of re-supplying that information. |
